if she was pulled over for a non working tailight, and thats it, the arrest may be illegal...You see, he had to be pulled out of the car for a reason, or consent to search the vehicle/himself had to have been given, which im sure it wasnt (either one couldve given consent being that they were both in the car. Not consenting to a search does not give give reasonable suspision to search however. Therefore, the police had to have seen something in PLAIN VIEW. i stress that word, b/c the cop would have had to see something in the car, while he was outside, looking in. Even if he sticks his head in 1", it becomes illegal. So, from what your telling me, which isnt a lot, and im sure the truth wouldnt really be admitted, the arrest is illegal, and evidence is not admissable in court due to the exclusionary rule. im not sure where you live, but chances are you can get a conditional discharge, which will basically be a few hundred in fines, and one year probation. Assuming he does not get in trouble for that year (maybe two) the charges can get expunged after a couple years.
